Terms of Use
Effective October 22, 2026
These terms apply to your use of mastera.works and to working with Mastera Works, a trade name of Mastera Ventures LLC (“Mastera Works,” “we,” “us”). By using the website or our services, you agree to them. If you’re using them on behalf of a business, you agree for that business.
1. Using the website
The content on this website is general information about technology and our services. It isn’t advice for your specific situation, and reading it, contacting us, or taking a survey doesn’t create a client relationship. Please don’t send us confidential information through the contact form.
You agree not to misuse the website, for example by attempting to disrupt it, access areas you aren’t authorized to use, scrape it at scale, or submit spam or harmful content.
2. Our services
Mastera Works provides independent technology advisory, strategy, and implementation services. Each engagement is described in a written proposal, statement of work, or engagement agreement (an “engagement agreement”) that sets out the scope, fees, and deliverables. If an engagement agreement conflicts with these terms, the engagement agreement controls.
- We act as an independent advisor. We don’t commit you to purchases without your approval, and we disclose any vendor relationships relevant to our recommendations.
- Decisions about your business, technology, and vendors remain yours. Our advice is based on the information available to us at the time.
- We aren’t a help desk or managed service provider and don’t provide 24/7 support or monitoring unless an engagement agreement says so.
3. Fees and payment
Fees are set out in your engagement agreement or invoice. We send invoices through Stripe, and payment is due by the date shown on the invoice. If you believe an invoice is wrong, please tell us within 30 days so we can resolve it. We may pause work on overdue accounts after letting you know.
4. Recorded calls
We may record and transcribe virtual calls to keep accurate notes and prepare deliverables, as described in our Privacy Policy. We’ll tell you before recording. By staying on a call after being told it’s being recorded, you consent to the recording. You can ask us not to record, or to stop, at any time. If you invite others, you’re responsible for letting them know the call may be recorded.
5. Confidentiality
We keep non-public information you share with us during an engagement confidential and use it only to provide our services, except where it is already public, you permit us to share it, or the law requires disclosure. An engagement agreement or separate confidentiality agreement may add to these commitments.
6. Your responsibilities
- Provide accurate information and timely access to the people and systems we need.
- Only share materials and data you have the right to share with us.
- Keep your own backups and follow your vendors’ instructions when implementing changes, unless we’ve agreed in writing to handle those tasks.
7. Intellectual property
The website and its content belong to Mastera Works. Ownership of deliverables is set out in your engagement agreement. Unless it says otherwise, once you’ve paid in full you may use the deliverables we create for you for your internal business purposes. We keep ownership of our pre-existing materials, tools, templates, and general know-how.
8. Third-party products and links
We may recommend, configure, or link to products and services from other companies. Those products are governed by their providers’ terms, and we aren’t responsible for their performance, availability, or data practices.
9. Disclaimers
The website is provided “as is.” To the extent permitted by law, we disclaim implied warranties, including merchantability and fitness for a particular purpose. We provide our services with reasonable care and skill, but technology projects involve risk, and we can’t guarantee specific outcomes, savings, or results.
10. Limitation of liability
To the extent permitted by law, Mastera Works won’t be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the website or our services is limited to the fees you paid us for the services giving rise to the claim in the 12 months before it arose. An engagement agreement may set different limits.
11. Governing law
These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Maricopa County, Arizona, unless an engagement agreement provides otherwise.
12. Changes and contact
We may update these terms from time to time by posting a new version here with a new effective date. Changes don’t affect engagement agreements already in place unless both of us agree.
